Webber Wentzel won the
ESG Initiative of the Year Awardat the 2023 African Legal Awards for the pro bono advice it provides
to the Minerals Council of South Africa's (MCSA) Partnership to tackle Gender-Based Violence in Mining Communities.
The MCSA's Partnership to tackle Gender-Based Violence in Mining Communities is a first-of-its-kind impactful initiative focusing on the social and socioeconomic environment. Thus far, Webber Wentzel's role in this initiative consisted of providing legal and commercial advice, establishing the partnership (with parties such as the MSCA, the Gender-Based Violence and Femicide Response Fund and the National Prosecuting Authority), as well as drafting the Memorandum of Understanding (MOU) between these parties.
The firm has also streamlined and facilitated the involvement of the mining industry in providing support and resources to Thuthuzela Care Centres as part of an organised and deliberate contribution to the efforts to help any person, including those in mining communities and labour-sending areas where research indicates the presence of GBVF.
When one or more parties to the MOU and other government departments need to come to an agreement, Webber Wentzel will continue to support this project by providing advice and helping to draft and negotiate the necessary agreements. According to the MOU, after mining companies have chosen a partnership opportunity, the NPA will enter into individual agreements outlining the implementation process.
